TERMS OF USE

By installing, accessing, or using the Nirman mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). The App is published by GMS Jain Jewellers Private Limited ("the Company").

The App may be used by anyone to view live gold and silver rates. In addition, the App provides a staff portal (sales, inventory and attendance) restricted to authorised employees and sales agents of the Company. The staff-portal provisions of these Terms — including the location and camera consents below — apply only to users who log in as staff.

The gold and silver rates shown in the App are indicative reference rates based on live market data, provided for general information only. They are not an offer to buy or sell and do not represent the final counter price.

The actual price of any item at our store will vary and depends on making charges, GST, hallmarking, design, weight, purity, and prevailing rates at the time of purchase. Please confirm the final price at our counter. The Company is not liable for any decision made solely on the basis of the indicative rates shown in the App.

You may use the App only for the following business purposes:

• Processing jewellery inventory scans, sales transactions, and returns
• Recording daily attendance with location and photograph verification
• Submitting product requirement requests on behalf of customers
• Accessing sales, inventory, MIS, and attendance reports assigned to your role
• Managing customer information within your permitted access level

Any use of the App outside these authorised purposes is strictly prohibited.

• Your login credentials are personal and confidential — they must not be shared with anyone, including colleagues
• You are solely responsible for all actions taken under your account
• The App enforces single-device login — signing in on a new device automatically terminates your session on all other devices
• Passwords are encrypted using industry-standard bcrypt hashing
• Multiple failed login attempts will trigger CAPTCHA verification and may result in temporary account lockout
• If you suspect unauthorised access, notify your manager or administrator immediately

This section applies only to authorised staff who log in. Public users who only view rates are never located. By logging in and accepting the in-app location disclosure, staff acknowledge and explicitly consent to:

• Continuous background location tracking while the App is running (even when not on screen)
• Location data being transmitted to Company servers approximately every 5 minutes
• Location data being used to verify field visit attendance and route coverage

A persistent notification is displayed whenever location sharing is active. You may revoke location access at any time through your device Settings, though this may limit App functionality and affect attendance verification.

Camera access applies only to logged-in staff, and is requested only the first time the scanner is opened. When used, you consent to camera access for:

• Scanning QR codes and barcodes on jewellery items for inventory and sales processing
• Capturing attendance verification photographs when using the check-in feature

The camera is only activated when you explicitly open the scanner or attendance screen. No images are captured without your direct initiation.

You must not:

• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
• Access, modify, or delete data belonging to other users
• Share, export, or disclose customer data, sales figures, pricing, or any confidential business information accessed through the App
• Attempt to bypass, disable, or circumvent security controls, authentication mechanisms, or IP-based access restrictions
• Use automated tools, bots, scrapers, or scripts to interact with the App
• Spoof your GPS location or use location-mocking software while using the App
• Install the App on devices not authorised by the Company
• Screenshot, record, or distribute App content for unauthorised purposes

All content, features, functionality, design, trademarks, and underlying technology of the App are the exclusive property of GMS Jain Jewellers Private Limited and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your authorised employment duties. This licence terminates immediately upon cessation of your authorised use.

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

You may request deletion of your data at any time through our Data Deletion Request page.

The Company reserves the right to suspend or revoke your access to the App at any time, without notice, if:

• You violate any provision of these Terms
• You misuse the App or its data
• Your employment or authorised relationship with GMS Jain Jewellers Private Limited ends
• The Company determines that continued access poses a security risk

Upon termination, you must immediately cease all use of the App and uninstall it from your device.

The App is provided "as is" and "as available". The gold and silver rates are indicative only (see the Rate Disclaimer above). While we strive for reliability and accuracy, the Company does not warrant that:

• The App will be uninterrupted, error-free, or free of security vulnerabilities
• Data transmitted through the App will always be accurate or complete
• The App will be compatible with all devices or operating system versions

To the maximum extent permitted by applicable law, GMS Jain Jewellers Private Limited shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of business, or device damage.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Significant changes will be communicated through the App or by your employer. Continued use after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.
